Our Legal System Is Changing
Brexit presented a unique challenge to our legal system. On the one hand this was a huge rupture with the past as legal norms were thrown up in the air. On the other hand, if Brexit was going to be anything close to a success then there would have to be at least some semblance of continuity.
Into the breach stepped retained EU law. The idea was that the law would essentially remain the same but now the power lay with politicians and judges in the UK to overturn rules that they did not like.
Despite some challenges identifying retained EU law, the system has worked fairly well and provided businesses, workers, and other individuals a degree of certainty over the Brexit process. Now though, a political appetite for more radical change has swept across Whitehall and our legal system might struggle to recover.
